YES if prosecutors file a formal “Notice of Intent to Seek the Death Penalty” in the case against the person charged with killing Charlie Kirk in Utah state court (Utah Code §76-5-202(3)), or if the U.S. Department of Justice files a federal death-penalty notice under 18 U.S.C. §3593 in a related federal case.
